Minutes of the Parish Council Meeting held on 21 March 2019 

in Bayford Village Hall at 7.30pm

Public Forum:

Mark Warren made a presentation of the plans for the application for the Unicorn Inn. To make the pub a viable financial proposition it would need to take around £4,000.00 per week. It would have 2 rooms for rental and the annexe. There would be kitchen facilities for doing limited food. Parishioners and Councillors asked many questions and it was felt that it may not be possible to achieve the £4,000.00 per week needed to make the pub a financial proposition. However, the plans shown and the ideas given formed the basis of the application to be applied for. The general feeling of the parishioners was that the pub was desirable for the benefit of the village.

NB: Councillor Linsley did not partake in the Public Forum discussion.

Proposal:  Application to vary conditions 02 of approval 13/001459/FUL – occupancy. – Permitted with conditions.

Several residents of Stoke Trister had reported to Cllr Macfarlane on the dangerous structures at East View and the seriousness of the situation. It has been reported to Planning who are dealing with it.

74. Highways

Cllr Macfarlane noted that the drains had been pumped out. Cllr Grant reported that new barriers had been installed in Beech Lane.

Cllr Summerfield was unanimously voted to be the Highways Officer.

75. Footpaths

Cllr Grant reported that ramblers have been in and around Frith Farm. He has noted the stiles that need repair.

76. Riding Gate

Cllr Linsley spoke of the riding Gate issues at the Area East Meeting. Cllr Linsley thanked Cllr Groskop and Cllr Beech for their input and help at the meeting. Tim Cooke was requested by the Chairman Nick Weeks to contact planning to escalate the situation after being allowed to go on for so long. To be discussed at the next Area East Meeting on 10 April 2019 at 9 am.

77. Defibrillator

Cllr Linsley had spoken to Lottery Funding about the defibrillator. They requested a survey from parishioners to see if that is what was wanted. Cllr Linsley did not have the time to do another survey on the village. Cllr Grant wished to know the need for a defibrillator as it would be possible for him to get funding from one of his charities. South West Ambulance appeared to be quite good but the cost was £1,800.00 per year. Cllr Linsley has 3 people to monitor the defibrillator for when it goes ahead.

It was decided to leave the decision until the July meeting.

78. Unicorn Inn

As discussed in Public Forum.

79. Tender

The tender for grasskeep for this season went to Stuart Barfoot.

80. Payman

It was unanimously agreed to allow the increase in fees.

In Cllr McKenna’s absence Cllr Garrett had contacted Tim Cook re the defibrillator. He said that SSDC’s Community Grant Scheme will fund up to 50% of the total cost of a defibrillator.

39. Notice Board

Cllrs voted unanimously to allow Phil Light to repair the Bayford Notice Board. Cllr Linsley to arrange.

41. Area East Meetings

After discussion it was decided to check the online Agenda for the Area East Meetings to see if it was relevant to out Council. Clerk to send to Chairman.

Mark Warren’s email was reported re Unicorn Inn. He stated the owners were to apply for a change of use followed by a Planning Application for three dwellings

Proposal: The erection of an oak framed detached garage building incorporating home officer and ancillary accommodation.- 

  1. It is unclear from the map exactly where the building would be situated.
  2. The most sensible positioning would be if the old stables were demolished and the new building sited there.
  3. Please clarify if this is the case, if so, we have no objection to the application.
  4. One query would be have they obtained planning permission for the new stables in situ at the moment.

NB. Mrs Andrews contacted the Chairman to state she would be away on holiday at the time of the meeting.

  1. Proposal: Conversion of an existing outbuilding to an annex/holiday let.- On principle restoring this building there are no objections. It is a positive approach to restore and old building.
  2. One comment we wish to make is that the existing pantiles be used rather than the tiles on the application. This would maintain the character of an old building.
  3. When we reviewed the planning Application No: 19/00448/HOU we requested that the mobile home should be removed.
  4. We note that that there is now a substantial wood cladded building in place now. Has planning permission been granted for this? 
  5. Will this also be used for a holiday let?
  6. Will planning permission be required for change of use for both of these buildings for holiday lets?

Chairman handed out papers for Councillors comments regarding the planning departments non-acceptance of our decisions. The Chairman and Vice Chairman will meet with Simon Fox for discussions on this issue. It was agreed to invite Henry Hobhouse and Alex Parmley to the meeting.

50. Highways

Cllrs Summerfield and McKenna had a very informative meeting with Gary Warren. Gary Warren recommended the Gateway signs to be set in Bayford as they were extremely effective with drive slowly signs in Riding Gate. Chairman requested that they provided costings for supply and installation. It was agreed that the Clerk write to Tim Cook requesting a donation towards the cost. It was also agreed to put information in the Newsletter including any donation.

51. Footpaths

Cllr Grant reported issues with the footpaths across to Mr Perrett’s land. Repair work and clearing needs to be done. Mr Perrettt needs to clear the land but if this is not done and SSDC needs to be called in to do it Mr Perrett will be issued with the account for the work.

52. Riding Gate and East View

Clerk continues to contact Sam Fox on a regular basis but no further information has been given on both of these issues. Cllr Bastable was having a meeting with Sam Fox to discuss both issues. Cllr Summerfield reported that there were still many vehicles at the Riding Gate fields.

53. Defibrillator

Cllr McKenna had been speaking with a lady at South Somerset Ambulance. After a long discussion with the Councillors there were many more questions to be answered. Cllr McKenna agreed to speak with her again to clarify all questions.

54. Clerk Appraisal

Chairman conducted a successful appraisal with the Clerk.

55. Unicorn Inn

The Unicorn Inn appears to be closed except for special occasions according to the blackboard notice on the entrance door.

56. Precept

The Precept was unanimously agreed by all Councillors. Clerk to check on the Community Council to see if it is still necessary to belong to. 

57. Online Banking

It was agreed that the Chairman would check online to be able to begin and access Online Banking.

Proposal: Application of reserved matters following approval of 18/02145/OUT for the erection of a two storey detached dwelling to include access, appearance, landscaping, layout and scale.- At a site meeting today, the following observations were made by Stoke Trister with Bayford Parish Council: The Councillors were unable to access the site as no one was available to ask permission. 

1. Devenish Lane is a rural settlement and this application does not conform with the requirements of the SS2 housing need within the SSDC Local Plan 2006-2028. 

2. Devenish Lane is a dangerous single-track lane encountering a lot of traffic at present. Further development will cause more traffic and more distress to residents. 

3. There will be a massive amount of drainage work to be done. 

4. We reiterate our previous observations for this application made on 28 September 2018. 

5. Stoke Trister with Bayford Parish Council therefore unanimously refuse this application. 

Some Councillors mentioned that the owners were running a business from this site with no planning permission. This has been previously addressed to the Planning Department, however, we are unaware what, if anything, has been done about it.

Proposal:  The erection of a new single storey dwelling and the formation of a new vehicular access off Bayford Hill – re-submission

Decision:

The site planning meeting was attended by all 7 Councillors, 4 of whom were new to the Council.

This application was unanimously refused by all Councillors on the basis of:

  1. The plot in question is far too small for any development.
  2. The recreation space is not sufficient for 2 properties.
  3. We reiterate our previous concerns over the dangerous access onto Bayford Hill. We believe that Highways has not visited this site before making their observations. We ask that Highways at SSDC visit this site before any decision is made by the planning officer.
  4. It would be taking away a decent family house and garden.
  5. As this is one of a pair of semi detached properties any development as applied for would make it disproportionate on one side of a garden.
  6. It is basically garden grab and overdevelopment.

The Chairman stated that the applicant had contacted her by telephone asking if the meeting could be moved to another day as she was unable to be there. The Chairman’s response was that we couldn’t and she should try to get a representative to be there.

Residents are concerned over the speeding traffic along the Riding Gate to Leigh Common road, as there is no speed limit. Cllr Summerfield requested a meeting with Gary Warren of Highways to request a speed limit lowering. Clerk to send Cllr Summerfield and Cllr McKenna contact details for Gary Warren. 

Cllr Summerfield was unanimously voted to be the Highways Officer.

24. Footpaths

Cllr Grant is checking on the identity of a stile that needs repair.

25. Riding Gate and East View

Ongoing problems being dealt with by Sam Fox of the Planning Dept, no further information at present.

26. Defibrillator

It was agreed that Cllr McKenna would do a costing for a defibrillator. Clerk to contact Andy Smith for his previous survey for a defibrillator. Cllr Grant would speak with Mr Trueman of Cucklington for more information.

27. Notice Board

It was agreed to contact Phil Light for a price for Notice Boards.

Minutes of the Parish Council Meeting held on 10 January 2019 

in Bayford Village Hall at 7.30pm

Public Forum:

Mr Millican and Mr MacFarlane made a presentation for revised building plans for Windmill Farm on Bayford Hill. They have made a reduced revised plan from having 150 dwellings to 90 dwellings.  It is uncertain at this time how many houses will be sited within the Wincanton boundary and how many within Bayford.  These units were to include affordable housing at 33% of the overall site. Mr MacFarlane suggested having a Public Meeting to show all interested parties and this will be arranged in the near future.

Mr Whitmarsh spoke about the reasons he was getting mail from the Council re his vehicles on the land in Riding Gate and also why there were complaints about this and also someone living in a mobile home on the site. The Chairman explained that the Parish Council had complaints from parishioners about this and consequently it was followed up by the Council. He also explained that it was no longer in the Parish Council’s hands and was under enforcement with SSDC.

Proposal:  Application to vary conditions 02 of approval 13/001459/FUL – occupancy.

Decision:

At a site planning meeting on 16 November 2018 Stoke Trister with Bayford Parish Council made the following observations.

The applicants, Mr and Mrs Davis, are applying for change of use to “sui generis to include agriculture/equestrian and animal rescue charity, and the erection of a building for use as a training centre in association with all elements of the rural enterprise at (Willow Tree Farm, Stoke Trister, BA9 8NQ). 18/03347/S73 They are also asking for the current occupation restriction on the dwelling on the property which is “limited to a person or mainly employed, or last employed, in the locality in agriculture …, or in forestry …, to be altered so as not to restrict occupation by any “rural worker”. 

Stoke Trister with Bayford PC (STWB PC) were told by Mrs Davis that she intended to run a Pet Grooming business and Mr Davis would run a alpaca farming business.

Under South Somerset’s Local Plan 2006-2028 policy EP4 asks the question:- 

1.      Is the business needed in this location and if the nature and volume of traffic generated by the development would have a detrimental impact on the character or amenity of the area and would compromise the safety and/or function of the road network in terms of both volume and type of traffic it would not be allowed.

Willow Tree Farm is sited on a busy A road with a speed limit of 60 mph and with two difficult bends limiting visibility.  

The applicants plan to run as one of the many businesses proposed on this site training courses for up to 30-40 students per year and in addition to employ 2 fulltime staff and 4 volunteers on a daily basis.  

STWB PC do not consider this site suitable for the increased amount of traffic on a busy and dangerous road.  The current owners in their previous application in 2013 received permission for parking 3 cars on site and it stated that they must be able to turn and not reverse onto the main road.  There would be on average eight cars a day and more when the courses proposed by the applicants are running and if this application were approved turning would not be an option and reversing onto the main road would be inevitable and dangerous.

STWB PC do not consider this application qualifies under Policy EP5 Farm diversification.  The previous “alpaca business” conducted at Willow Tree Farm is now defunct, and there is little evidence that alpaca farming nowadays on such a small acreage (approx 4 acres) could be made commercially viable. Pet Grooming on the other hand, which is what Mrs Davis said would be the main enterprise she would be wishing to start at this property, is not considered as agricultural use. The site is situated in a predominantly rural landscape and as such only limited development is allowed.

The new training centre structure envisaged in this application although quoted as being modest in size would be far larger than the existing barn on the site.

Stoke Trister with Bayford Parish Council accordingly unanimously recommends refusal of these applications.

Location:  School House Farm, Bayford Lane, Stoke Trister.

Proposal:  Demolition of outbuilding and the erection of a replacement building to be used as an annexe (revised application) – No objections.

Planning Application No: 18/03272/FUL

Applicant: Hopkins Estates Ltd

Location:  Land OS 3969 Part Devenish Lane, Bayford, Wincanton

Proposal:  The erection of three dwellings with ancillary works and new access.

Decision:

With reference to planning application 18/032772 on Land 0S3969 Part, Devenish Lane, Bayford for the erection of 3 dwellings with ancillary works and new access.

The site is on a narrow single track lane which according to local residents already suffers traffic stress on a regular basis from large delivery vehicles with no passing bays (other than by pulling into other residents front drives) and the only turning place being at the end of this no through lane.  Local residents report that they already frequently have to back up as a result of meeting other traffic in the lane, and we would therefore challenge the assertions in the applicants’ Planning Statement  that “The probability of two vehicles using the narrowest section of Devenish Lane at the same time is 1 in 289” and that “There are at least 5 passing places where in the unlikely event two vehicles meet travelling in the opposite direction.”

Contrary to what is stated in the Planning Statement for this application the site is NOT within the boundary of the market town of Wincanton so all references on pages 11-24 of the planning statement are irrelevant.  The land is in the rural settlement of Stoke Trister with Bayford where different housing criteria apply.  

The development plan which applies to this application is one of a rural settlement (South Somerset Local Plan (2006-2028).  The policy most relevant to this application is:-

SS2 which states that developments will be strictly controlled and limited to that which:-

Provides employment opportunities appropriate to the scale of the settlement, and/or

 Creates or enhances community facilities and services to serve the settlement and/or

Meets identified housing need, particularly for affordable housing.

This application fails to fulfil any of the above requirements.

Moreover the scale and design of the proposed dwellings are totally inappropriate in our rural settlement.

We also note that the recent Wincanton town plan which was adopted by referendum earlier in the year, and has been independently verified by an impartial planning inspector and has been formally adopted by SSDC, clearly states the direction of growth should be away from Bayford not towards it.

In an Appeal Decision APP/R3325/W/17/3180025 Land OS 1200, Bayford Hill dated 9th January 2018 the Inspector appointed by The Secretary of State for Communities and Local Government dismissed the developer’s appeal stating “Notwithstanding that LP Policy SS5 provides for the consideration of housing proposals adjacent to the development area, the proposed development would conflict with LP Policies SS1 and SS2”. 

We would also maintain that it is not the responsibility of Stoke Trister with Bayford parish (STWB) to fulfil the wider housing needs of the district but only to fulfil the housing needs sufficient to sustain its rural settlement.

Further, we would contend that as Policy SS2 relates to the sustainable development of rural settlements not the wider housing needs of the district, it does NOT necessarily become “out of date” with the rest of the Local Plan.

In view of the above, and in particular having regard to the fact that the development is clearly within the parish of Stoke Trister with Bayford and therefore the criteria that should be applied are those for rural settlements, the unanimous opinion of the Parish Council was to recommend refusal of this planning application.  The boundary between Stoke Trister with Bayford and Wincanton should not be blurred.

Planning Application No:  18/03668/FUL

Applicant: Mr & Mrs Shane Scammell

Location:  Riding Gate Cottage, Riding Gate, Stoke Trister, Wincanton. BA9 8NQ

Proposal:  Conversion of barn to dwelling.

Decision:

At a Site meeting at the above application Stoke Trister with Bayford Parish Council made no objections to the initial application as it complies with the NPPF regulations regarding rural development. Councillors would however like to see the immediate area in front of the property softened with some gentle landscaping.

Councillors noted a barn within the curtilage owned by the applicant is being used as an extension to his business premises in Bennett’s Field Garages by doing mot testing. We would be concerned if there were plans to increase the workload at this site. 

Councillors also noted a static caravan on the site which seemed well established with a small garden on the site and we question whether conditional on this caravan being removed once the habitation certificate has been granted.

Proposal: The conversion of existing domestic storage building into a single dwelling and the erection of a car port. – We recommend refusal of this application since the applicant has not demonstrated that the proposal would meet the requirement of SS2 in the local plan. However, we understand that the barn conversion proposed would be for family use only and we would be sympathetic to this if a new application was made for conversion ancillary to the existing dwelling on the property. – No further information.

61. Highways

Cllr Smith reported some of the potholes in Bayford had been repaired also the drains had been cleaned out.

Cllr Macfarlane spoke about the altertation of the ROW in Devenish Lane stating that the boundary should not be changed. Cllr Linsley spoke about the email from Lauren Edlrid who in dealing with the ROW diversion. Clerk to contact Lauren Eldrid to an update on the ROW and a plan of the new diversion.

It was unanimously agreed not to have the yearly SID installation.

Cllr Grant has received paper from Taunton SCC stating he is officially the Footpaths Officer. He also reported a dangerous stile WN/28/22.

Cllr Linsley has applied for an up to date price of a defibrillator. She also needs 2 people to do small tasks to do with the defibrillator which she has in mind at present.

4. Chairman’s Report

Welcome. In the last year 16 planning applications were dealt with and it is anticipated that the coming year will see further and perhaps considerable more in this directions. The Unicorn has been much discussed. No final decision has been made on the acquisition or otherwise of a defibrillator or a S.I.D. Constant pressure will have to be kept on District to maintain the parish’s infrastructure. However, the major problem facing Stoke Trister & Bayford in the immediate future is membership. It takes 3 Councillors to be present together to be quorate. We are supposed to have 7 but there are 3 vacancies. Under these circumstances, sickness or holidays can make it easy to fall short to 2 and be unable to conduct any business. If you think you can help, the workload is not too onerous – see the Clerk.

I would like to thank on your behalf as well as on my own Anna Groskop and PCSO Tim Russel for their frequent attendance and assistance. Also the neighbourhood watchers and my fellow Councillors and last but not least the Parish Clerk, all of whom have helped me in the position of Chairman over 16 years. It has been both a pleasure and a privilege to have been able to serve the Parish over that length of time, but, the time has now arrived for fresh blood to take over and face the battles ahead. 5. PSCO Tim Russell’s Report .

Only 2 crimes were reported in the last month. Workman’s vans are being targeted and sheds need to be securely locked as thieves are still after tools and machinery.

6. Neighbourhood Watch Report

Peter Munro regularly patrolled the village for any problems but everything seemed to be fine.

7. Public Question Forum

Robin Bastable received an email from Janet Montgomery from Brimble Lee who wanted an on-site meeting with him at Church Farm. Robin wanted to know the feelings of the Parish Council with regard to the planning application made by Church Farm. The Planning Officer was recommending refusal and the Councillors requested the grounds on what the main objections were. The Parish Councils decision was split on this request and the application will possibly go to Area East for a final decision

Cllr Grant reported a padlocked stile in Stoke Lane near the A303. It was said to be padlocked to protect Mr Perry’s horses. Councillors suggested opening up another gate for access. Cllr Grant reported other stiles that needed repair.

Clerk was instructed to keep the pressure up on both of these problems.
