Agenda 21 March 2019

Stoke Trister with Bayford Parish Council___________________

Notice of Meeting

MEETING

OF THE PARISH COUNCIL

Thursday 21 March 2019 at 7.30pm

Bayford Mission Hall

AGENDA

Public Forum: Prior to the start of the meeting the Chairman gives leave to members of the public to speak.

1. Apologies for absence

2. Declaration of Interest

3. Minutes of the Parish Council meeting held on 10 January 2019 and Planning Meetings of 8 February and 8 March 2019

A resolution is sought to approve and sign the minutes as a true record

4. Planning Matters

New planning matters.

Planning Application No:

Applicant: Mrs J Calderwood

Location:  Land rear of 2 Cambria Villas Devenish Lane Bayford Wincanton. BA9 9NG

Proposal:  The erection of a new single storey dwelling and the formation of a new vehicular access off Bayford Hill.

Decision:

At a site meeting held today Stoke Trister with Bayford Parish Council make the following observations on the above application:

  • We have very strong concerns about the size of the building compared to the space available.
  • We also have strong doubts about the wisdom of another entrance onto Bayford Hill being not very far from Devenish Lane.
  • We also wonder if flat roofs are permissible by SSDC.
  • Our Councillors were mixed in their views regarding approval.

Planning Application No: 19/00258/OUT

Applicant: Mr M and Miss F Haskett and Thornton

Location:  Land at Church Farm, Stoke Trister, Wincanton BA9 9PG

Proposal:  Outline application with all matters reserved for the redevelopment of Church Farm buildings and bungalow and erection of 2 dwellings. – Stoke Trister with Bayford Parish Council attended a site planning meeting today. The Parish Council met with Mr Haskett’s representative Janet Montgomery and 9 members of the public. The Council was split on several facets of the application as under:

  1. Some were in favour of allowing the 2 dwellings being constructed subject to approval of detailed plans.
  2. Clear majority wanted a ban on further future development on this site.
  3. All the Councillors felt that the destruction of the farm buildings i.e the barns and the bungalow would mean that the farm was being killed off completely (the country needs farms) leaving a large tract of land with inadequate access and is not in keeping with current policies.

The nine residents of Stoke Trister present at this meeting raised the following concerns:-

1.  The lanes are not suitable for extra traffic being single track and there will be difficulty accessing the farmland if the farmyard is developed as a residential site.

2.  The Parish Plan states that there is no support for development within this rural settlement.

3. If two houses are permitted it could create a precedent and more housing could follow.

4.  Why demolish a 1980’s bungalow which could be let to a family?

Planning Application No: 19/00373/FUL

Applicant: Mr & Mrs Garrett

Location:  Highcroft, Bayford Lane, Stoke Trister, Wincanton. BA9 9PG

Proposal:  Erection of a new dwelling. – Mr Garrett explained the proposal with plans and drawings to build a ‘1.5 house’ for them to occupy + a detached garage to the front of the property. The house will face the valley to take in the exceptional views.

Public discussions:

As Mr Garrett owns the bungalow at the back of and adjacent to the land, why not knock that down and build a family home out there with the garden embracing the land under discussion. He said the footprint would not be suitable.

Where are the boundaries on the roadside of the land? Who owns them?

Mr Garrett explained that there are 2 boundaries, the large trees form inner boundary which he owns and the outer boundary which is owned by the council although it has not been maintained by them. It had posts and wire which was falling down and decrepit and Mr G had to remove them as they were causing potential hazard.

Does the land require permission to cross council land, i.e. access? Mr Garrett did not think so as he can access his land now.

Concern regarding water run-off with all the digging that will occur when building work commences.  (Public member mentioned the issues next door on Butts Farm where water run off is a major problem). It was deemed this building work would be a one-off so should not be an issue.

Does the land need a Geological survey?

There is a house at the bottom of the land. Apparently, the owner is neutral on this proposal as long as only one property is sanctioned. The lady at the bottom of the land had requested a Geological Survey to verify the stability of the land and the safety of run off and drainage.

How tall will the building be?

Mrs Garrett explained that the house will be 1.5 storeys tall house and will be built into the slope at the back. Some discussion took place as to whether it is 1.5 or 2 storeys.

Parish Council decision:

Unanimous agreement for permission to be granted as long as the comments above can be addressed. It was important to state that the Councillors thought local residents who have been in the area for long periods as Mr & Mrs Garrett have, should be encouraged and supported with plans to stay in Stoke Trister.

OF THE PARISH COUNCIL

AGENDA

Public Forum

Prior to the start of the meeting the Chairman gives leave to members of the public to speak.

4. Planning Matters

a. New Planning Matters

Planning Application No: 19/02457/HOU

Applicant: Mr & Mrs Andrews

Location: Park Farmhouse, Beech Lane, Stoke Trister. BA9 9PQ

Proposal: The erection of an oak framed detached garage building incorporating home officer and ancillary accommodation.-

  1. It is unclear from the map exactly where the building would be situated.
  2. The most sensible positioning would be if the old stables were demolished and the new building sited there.
  3. Please clarify if this is the case, if so, we have no objection to the application.
  4. One query would be have they obtained planning permission for the new stables in situ at the moment.

NB. Mrs Andrews contacted the Chairman to state she would be away on holiday at the time of the meeting.

Planning Application No: 19/02369/FUL

Applicant: Mr Simon Minney

Location: Riding Gate House, Riding Gate, Wincanton. BA9 8NQ

  1. Proposal: Conversion of an existing outbuilding to an annex/holiday let.- On principle restoring this building there are no objections. It is a positive approach to restore and old building.
  2. One comment we wish to make is that the existing pantiles be used rather than the tiles on the application. This would maintain the character of an old building.
  3. When we reviewed the planning Application No: 19/00448/HOU we requested that the mobile home should be removed.
  4. We note that that there is now a substantial wood cladded building in place now. Has planning permission been granted for this?
  5. Will this also be used for a holiday let?
  6. Will planning permission be required for change of use for both of these buildings for holiday lets?

a. New Planning Matters

Planning Application No: 19/01322/S73

Applicant: Hopkins Estates

Location:  Land OS 3969 Part Devenish Lane, Bayford, Wincanton.

Proposal:  Application to vary condition 2 (approved  plans) of planning approval 18/03272/FUL (amendment of roof material) – There were no objections to the change of roofing material. However, we would like to see the Planning Officers consultation with Wessex Water concerning the high pressure pipes underground.

Planning Application No: 19/01284/REM

Applicant: Mr. Shaun Paul

Location: Land adjacent to Highbrook, Devenish Lane.

Proposal: Application of reserved matters following approval of 18/02145/OUT for the erection of a two storey detached dwelling to include access, appearance, landscaping, layout and scale. – At a site meeting today, the following observations were made by Stoke Trister with Bayford Parish Council: The Councillors were unable to access the site and no one was available to ask permission.

1. Devenish Lane is a rural settlement and this application does not conform with the requirements of the SS2 housing need within the SSDC Local Plan 2006-2028.

2. Devenish Lane is a dangerous single-track lane encountering a lot of traffic at present. Further development will cause more traffic and more distress to residents.

3. There will be a massive amount of drainage work to be done.

4. We reiterate our previous observations for this application made on 28 September 2018.

5. Stoke Trister with Bayford Parish Council therefore unanimously refuse this application.

Some Councillors mentioned that the owners were running a business from this site with no planning permission. This has been previously addressed to the Planning Department, however, we are unaware what, if anything, has been done about it.

Notice of Meeting

MEETING

OF THE PARISH COUNCIL

Thursday 13 September 2018 at 7.30pm

Bayford Mission Hall

AGENDA

Public Forum: Prior to the start of the meeting the Chairman gives leave to members of the public to speak.

1. Apologies for absence

2. Declaration of Interest

3. Minutes of the Parish Council meeting held on 12 July 2018 and Planning Meetings of 29 June 2018 (missed at July meeting) and 31 August 2018.

A resolution is sought to approve and sign the minutes as a true record

4. Planning Matters

New planning matters.

Planning Application No:  18/01916/FUL

Applicant: Hopkins Developments Ltd

Location: Land adjoining Corner Farm, Devenish Lane, Bayford, Wincanton.

Proposal: The erection of timber gates (retrospective)

Decision:

After lengthy discussions between Councillors and parishioners strongly objecting to the developer Applicant’s erection of inappropriate “urban” type and height of fencing of the public footpath, and more recently timber gates across the line of the public footpath, coupled with the current lack of adequate footpath signage to encourage its use, it was decided that the Parish Council should register its agreement with those objections as follows:

1) The Parish Council notes that the Decision Notice dated 25 August 2017 pertaining to Application ref:- 17/02351/S73A is conditioned as follows

â€œNo building, structure or boundary enclosure shall be erected or the location otherwise obstructed within the annotated hatched area (see the website) applied to approved drawing

13091/002 received 4 August 2017.

Reason:-  in the interests of visual appearance and to maintain the character of the former cart track further to policy EQ2 of the South Somerset local plan 2002-2028”.

Both the high “urban” style close boarded fencing at the end of the Applicant’s property and the new gateway which have been erected by the Applicant across the line of the public footpath are in breach of that condition.

2) Additionally, the Parish Council will request Highways Group, SSDC, for the benefit of the public,

a) to erect a clear “Public Footpath” sign, not just the small yellow arrow nailed to the current gatepost.

b) to require the Applicant to delineate on the ground the extent (width) of the public footpath.

c) to require the Applicant to revert to a post and rails fence instead of close boarded fencing on the Bayford side of the public footpath, as discussed by the Parish Council last year with the then Case Officer handling the Application, Mr Lee Walton.

d) to confirm that the Applicant has applied (retrospectively) for consent to divert the public footpath to the line it now follows on the ground.

Planning Application No:  18/02228/FUL

Applicant: Mr Martin Mckenna

Location: The Well House, Bayford Wincanton.

Proposal: Alterations to change the pitch of the roof at the rear of the property and erection of a single storey side extension to create a sun/living room. -Stoke Trister with Bayford Parish  Council has no objections to this application as it will make a good improvement.

b. Outcome of planning matters already considered:

Planning Application Nos: 18/00933/FUL and 18/00931/COL

Applicant:  18/00933/FUL

Applicant:  18/00933/FUL

Location: Sunny Hill Park Campsite, Riding Gate, Wincanton. BA9 9NG

Proposal: Removal of caravans and the erection of 5 No chalets to be used for permanent residential occupation.

18/00931/COL

Application for a Lawful Development Certificate for the use of 3 No caravans as permanent residential occupation.

Decision:

On-site meeting held at Sunnyhill Farm (campsite), Riding Hill Gate, Wincanton BA9 8NG on 30th May 2018.

The Chairman clarified that, although the applicants’ campsite was situated just within the boundary of the neighbouring parish of Charlton Musgrove, notice of the Applications had been sent to Stoke Trister with Bayford PC by the planning authority, as was customary, so that the PC could express a view, if it wished, on its own behalf and on behalf of local residents.

The applicants and many of those present then expressed at considerable length their views for or against the two Applications.

After taking note of the representations made to them councillors decided to postpone coming to a conclusion until they had had the opportunity to consider further the planning history leading to these Applications.

Meeting held on 14th June 2018 at Bayford Mission Hall.

After lengthy discussion of the material submitted by applicants in support of the Applications, and other documents posted on the SSDC Planning Office website,

IT WAS RESOLVED

  1. That with regard to Planning Application 18/00931/COL in view of the lack of convincing evidence in support of the Application councillors recommend that a Lawful Development Certificate be refused.
  2. That with regard to Planning Application 18/00933/FUL councillors support Charlton Musgrove Parish Council’s recommendations, set out in their Clerk’s email of 24th May 2108 to SSDC Case Officer, Lee Walton, that the Application be refused.

Please note: The Rights of Way Officer should be informed as ROW’s numbers WN28/6 and WN8/10 run through this property and one is supposedly blocked.
