Land adjacent to Highbrook – Planning Officer at the time was Richard Hawkey

28 September 2018 – Stoke Trister with Bayford Parish Council had a site planning meeting for the outline permission for a detached two storey dwelling. Application No: 18/02145/OUT. Refusal was recommended by the Parish Council.

With correspondence between Cllr Smith and Mike Beech it was agreed that Cllr Smith would attend the Area East Meeting on 13 February 2019 to recommend refusal.

On 12 February 2019 Cllr Smith resigned from the Parish Council thus not attending the Area East Meeting and stating the Councillors reasons for refusal of this application. Area East Committee decided to pass this application despite the previous objections.

Stoke Trister with Bayford Parish Council had another site meeting on 21 June 2019 for the Reserved Matters. Application No: 19/01284/REM. Refusal was recommended by the Parish Council.

It came to light after both meetings that the land adjacent to Highbrook that the house was due to be built on was land with an agricultural tie as confirmed by John Millar in his email of 11 July 2019.

After John Millar’s departure David Kenyon took over his work. In David Kenyon’s very convoluted email of 23 July 2019, David Kenyon is implying  the Parish Council knew this was agricultural land after they had recommended refusal on both applications. Surely SSDC should have known this before they decided to pass the outline application.

It is decided to pass this case on to Val Keitch and Alex Parmley.

Decision:

  1. On principle restoring this building there are no objections. It is a positive approach to restore and old building.
  2. One comment we wish to make is that the existing pantiles be used rather than the tiles on the application. This would maintain the character of an old building.
  3. When we reviewed the planning Application No: 19/00448/HOU we requested that the mobile home should be removed.
  4. We note that that there is now a substantial wood cladded building in place now. Has planning permission been granted for this? 
  5. Will this also be used for a holiday let?
  6. Will planning permission be required for change of use for both of these buildings for holiday lets?

Proposal: Application of reserved matters following approval of 18/02145/OUT for the erection of a  two storey detached dwelling to include access, appearance, landscaping, layout and scale. 

Decision: 

At a site meeting today, the following observations were made by Stoke Trister with Bayford Parish  Council: The Councillors were unable to access the site as no one was available to ask permission. 

1. Devenish Lane is a rural settlement and this application does not conform with the  requirements of the SS2 housing need within the SSDC Local Plan 2006-2028. 2. Devenish Lane is a dangerous single-track lane encountering a lot of traffic at present. Further  development will cause more traffic and more distress to residents. 

3. There will be a massive amount of drainage work to be done. 

4. We reiterate our previous observations for this application made on 28 September 2018. 5. Stoke Trister with Bayford Parish Council therefore unanimously refuse this application. 

Some Councillors mentioned that the owners were running a business from this site with no  planning permission. This has been previously addressed to the Planning Department,  however, we are unaware what, if anything, has been done about it.

  • We have very strong concerns about the size of the building compared to the space available. 
  • We also have strong doubts about the wisdom of another entrance onto Bayford Hill being not very far from Devenish Lane.
  • We also wonder if flat roofs are permissible by SSDC.
  • Our Councillors were mixed in their views regarding approval.

Decision:

The site planning meeting was attended by all 7 Councillors, 4 of whom were new to the Council.

This application was unanimously refused by all Councillors on the basis of:

  1. The plot in question is far too small for any development.
  2. The recreation space is not sufficient for 2 properties.
  3. We reiterate our previous concerns over the dangerous access onto Bayford Hill. We believe that Highways has not visited this site before making their observations. We ask that Highways at SSDC visit this site before any decision is made by the planning officer.
  4. It would be taking away a decent family house and garden.
  5. As this is one of a pair of semi detached properties any development as applied for would make it disproportionate on one side of a garden.
  6. It is basically garden grab and overdevelopment.

The Chairman stated that the applicant had contacted her by telephone asking if the meeting could be moved to another day as she was unable to be there. The Chairman’s response was that we couldn’t and she should try to get a representative to be there.

Proposal: Erection of a new dwelling.

Decision:

Mr Garrett explained the proposal with plans and drawings to build a ‘1.5 house’ for them to occupy + a detached garage to the front of the property. The house will face the valley to take in the exceptional views.

Public discussions:

As Mr Garrett owns the bungalow at the back of and adjacent to the land, why not knock that down and build a family home out there with the garden embracing the land under discussion. He said the footprint would not be suitable. 

Where are the boundaries on the roadside of the land? Who owns them?

Mr Garrett explained that there are 2 boundaries, the large trees form inner boundary which he owns and the outer boundary which is owned by the council although it has not been maintained by them. It had posts and wire which was falling down and decrepit and Mr G had to remove them as they were causing potential hazard.

Does the land require permission to cross council land, i.e. access? Mr Garrett did not think so as he can access his land now.

Concern regarding water run-off with all the digging that will occur when building work commences.  (Public member mentioned the issues next door on Butts Farm where water run off is a major problem). It was deemed this building work would be a one-off so should not be an issue.

Does the land need a Geological survey? 

There is a house at the bottom of the land. Apparently, the owner is neutral on this proposal as long as only one property is sanctioned. The lady at the bottom of the land had requested a Geological Survey to verify the stability of the land and the safety of run off and drainage.

How tall will the building be?

Mrs Garrett explained that the house will be 1.5 storeys tall house and will be built into the slope at the back. Some discussion took place as to whether it is 1.5 or 2 storeys. 

Parish Council decision:

Unanimous agreement for permission to be granted as long as the comments above can be addressed. It was important to state that the Councillors thought local residents who have been in the area for long periods as Mr & Mrs Garrett have, should be encouraged and supported with plans to stay in Stoke Trister.
